These Text Message Terms & Conditions govern the Bald Head Blues marketing text message program, operated by Maritime Market Ventures, LLC d/b/a Bald Head Blues ("we," "us," "our"). They should be read alongside our Privacy Policy.

1. Program Description

Bald Head Blues operates a recurring text message program that sends promotional offers, sale and restock announcements, new product news, and event information to customers who have opted in.

2. Marketing Messages vs. Transactional Messages

These terms govern our marketing text messages. We also send transactional text messages, and the two are separate:

  • Marketing messages promote our store: sales, promotions, restocks, new products and events. They require your express written consent, and replying STOP ends them.
  • Transactional messages relate to a specific order or request: order confirmations, shipping and delivery updates, and replies to customer service inquiries. We send these because of a transaction you initiated, not to market to you. They are not part of this program and are not governed by these terms.

Replying STOP ends marketing messages. It does not by itself stop transactional messages about an order already in progress. To stop those as well, contact us at privacy@baldheadblues.com or +1 910-457-7450.

3. Consent

By providing your mobile phone number and opting in, you agree to receive recurring automated marketing text messages from Bald Head Blues at the number provided, including messages sent using an automatic telephone dialing system.

Consent is not a condition of any purchase. You may buy from us without joining our text program.

You may opt in by:

  • Entering your mobile number and checking the SMS consent box on our website or at checkout
  • Texting a keyword to our number
  • Providing your number and consent in person at an event or retail location

Providing your phone number to complete an order does not enroll you in this program.

4. Message Frequency

Message frequency varies.

5. Cost

Message and data rates may apply. We do not charge for these messages, but your wireless carrier's standard messaging and data rates apply to every message sent and received. Contact your carrier for details about your plan.

6. How to Opt Out

Reply STOP to any message from us at any time. You will receive one final message confirming that you have been unsubscribed, and no further marketing texts will be sent to that number.

To rejoin, sign up again through any of the methods described in Section 3.

8. Supported Carriers

This program is available on most major wireless carriers in the United States. Carrier participation and support may change at any time without notice, and we cannot guarantee that the program will be available on every carrier or plan.

9. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may be affected by your carrier, device, coverage, or network conditions.

10. Eligibility

You must be at least 18 years old and the account holder or an authorized user of the mobile number you provide. If your mobile number changes or is reassigned, notify us at privacy@baldheadblues.com so we can update our records.

11. Privacy and Your Mobile Information

Information collected through this program is handled according to our Privacy Policy.

We share your mobile phone number and related text message information only with the providers that make this program work, and only so that it can work: Klaviyo, Inc., our messaging platform, which stores your number and consent record and sends the messages on our behalf; and the telecommunications and wireless carriers necessary to transmit each message to your device. These providers act on our instructions and may use this information only to deliver the program for us, not for their own purposes.

We do not sell, rent, or otherwise disclose mobile phone numbers, SMS consent records, or text message opt-in information to any third party or affiliate for that party's own marketing purposes. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.

All of the information-sharing categories described in our Privacy Policy exclude text messaging originator opt-in data and consent, and that information is not shared with any third parties.

12. Changes to These Terms

We may modify these terms at any time. Changes take effect when posted to this page.
